KODA SAIL Booking Conditions

OUR DUTY
1. Your Tour Reservation
  1. On receipt of your deposit, subject to availability, Koda Sail will reserve your place on your selected tour. A contract is only made between you and us upon your booking being confirmed and accepted by us and our confirmation thereof to you.

2. If We Cancel or Change Your Tour 
  1. Koda Sail reserves the right to change, modify, cancel or postpone any trip in accordance with operating requirements or circumstances beyond its control.

  2. Should change or cancellation prove necessary we will give you reasonable notice thereof, in the circumstances, and where available offer you a comparable alternative. Koda Sail is not responsible for other travel arrangements that you or your party have made outside of your Koda Sail trip and which are affected by our cancellations.

  3. If an alternative is not available or acceptable you will be offered one of the following;
    a) Refund of fare paid by you to us (less bank transaction fees),
    b) Transfer to another Koda Sail tour without payment of any transfer fee, or
    c) Travel Credit notice valid for 12 months.

  4. If the change or cancellation is due to Force Majeure (any event or circumstance beyond the control of Koda Sail) which may include but not limited to: Acts of God (such as earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning, adverse weather conditions or natural and nuclear disasters), industrial disputes, work ban or other labour dispute or difficulty, acts of terrorism, political unrest, war or threat of war, riots or civil strife, failure or delays to scheduled transportation and the closure of airports or ports, pandemic, epidemic or health risk, governmental and administrative actions (including closure of borders and travel warnings and restrictions) or other similar events beyond Koda Sail’s control, you will be offered one of the following;
    a) Refund of fare paid by you to us less expenses (non-refundable deposit & bank transaction fees) incurred by us in respect of your booking with your non-refundable deposit converted to Travel Credit to be used on future trips with Koda Sail (valid for 24 months from date of issue) or,
    b) Travel Credit notice (see 2.7 for Flexible terms) to be used on future trips with Koda Sail (valid for 24 months from date of issue). In this instance, your travel insurance is responsible in covering any losses incurred. Koda Sail can provide documentation to assist with any claims if required.

  5. Koda Sail reserves the right in cancelling departures with less than minimum participants (Croatia minimum 20 participants. Turkey minimum 12 participants. Maldives minimum 10 participants), and changing ship name and configuration if need arises. Koda Sail is not responsible for the costs of any other travel arrangements affected due to our cancellations or rescheduling of any tour departure. Reasonable notice will be provided.

  6. All refunds can only be returned by the same method of payment made to Koda Sail through our online payment system.
    We can not refund to another card or via bank transfer. If your bank can not accept the refund, your fare will remain as Travel Credit for future trips and made fully flexible as per our flexible terms for use (clause 2.7)
    Any bank transaction fees charged on the original payment are not eligible for refund. Koda Sail can not be held responsible for any additional fees your bank may charge to accept this refundRefund amounts are dependant on the bank’s currency conversion on the day. Koda Sail can not be held responsible for any gains or losses made by you in this transaction.

  7. Flexible terms for use of Future Travel Credit; 
    • Your Travel Credit & Bonus Credit is fully transferable for any future tour date or destination.
    • Name on your Travel Credit is fully transferable (must transfer the entire Credit amount. No split bookings).
    • Your Travel Credit & Bonus Credit can be split amongst multiple bookings/tours (in the same name).
    • Travel Credit & Bonus Credit can be applied to any already discounted Sale fares.
    • Travel Credit & Bonus Credit can not be redeemed for cash.
    • No additional promo codes can be applied when using Travel Credit.

    For Travel Credit given due to COVID-19 postponement on 2020 departures;
    • Travel Credit & Bonus Credit must be redeemed before December 31st 2023 (for travel in the 2024 season). 

  8. Book with Confidence Policy;
    • Risk Free Early-Bird bookings for 2023 season;  
    Travel Credit & Refunds: If your tour gets postponed or you can't travel due to any COVID-19 restrictions, you may choose to keep your booking and receive travel credit for future use on any tour in any destination, or cancel your spot entirely.
    If you choose to cancel your spot entirely (due to Covid restrictions only), your non-refundable deposit will no longer be forfeited, it will be converted to travel credit for use on any future tours, in any destination valid for 12 months. The remaining balance will be refunded less bank transaction fee 3.95%

3. Tour Details and Conditions
  1. Koda Sail will do their best, at their discretion, to select accommodation, optional excursions and transportation to give you good value for money.

  2. Koda Sail will endeavour to match you up with someone of the same sex when booked in a Twin-Share room configuration, but can not be guaranteed.

  3. Koda Sail constantly strives to improve tour itineraries and features. If such improvements can be made, or unforeseen circumstances beyond our control make changes necessary, we reserve the right to vary itineraries. Koda Sail is not responsible for any other travel arrangements affected due to our cancellations.

  4. We reserve the right to alter or substitute the type, the size of vessel, and/or the style of transport mentioned in the brochure, resulting in occasionally having to utilise transport without some of the features promoted.

  5. The Captain reserves the right in changing the route in case of bad weather conditions or on advice from local port authorities.

4. Liability
  1. Your travel agent shall, on the receipt of any monies, hold such monies for you until the booking is confirmed at which time those monies shall be remitted promptly by your travel agent to us. All such monies received by us will be deposited as required by law.

  2. All monies paid by you to us through your travel agent or otherwise, whether in respect of the deposit or full payment, may be disbursed by us as and when we see fit, in respect of the services to be provided and/or fees payable under the tour program. The payment of a deposit or any other monies in respect of your tour shall be deemed to be an authorisation for disbursement thereof as aforesaid.

FOR YOUR INFORMATION
5. Booking Your Tour
  1. In order to reserve your tour, a non-refundable deposit of EURO €250 per person (Croatia & Turkey), or USD$250 (Maldives) per tour, or the full amount payable if the booking is made within 45 days of your departure, must be submitted to Koda Sail by you in respect of that tour. This payment is in addition to any deposit required by your travel agent. The deposit is accepted as a first instalment of the tour price by Koda Sail only once the booking has been confirmed in writing by Koda Sail or your travel agent.

  2. Your reservation will be confirmed on receipt of a non-refundable deposit of EURO €250 per person (Croatia & Turkey), or USD$250 (Maldives) per tour which must be within 3 days of booking, or the reservation will automatically be cancelled. The remaining balance, full amount from which the deposited amount is deducted, is to be paid upon the date stated in the calculation/proforma invoice.

  3. Your successful payment of your deposit will also act as confirmation that you have read and agree with these Terms & Booking Conditions. 

  4. Any special meal requirements will be made on a request basis only. Koda Sail cannot guarantee special meal requests nor will it assume any responsibility or liability if clients’ special meal requirements are not fulfilled.

  5. You may also request additional information via email in regards to transfer and general transportation information from your arrival point to your cruise/program departure point. Koda Sail will assist you with additional information and possible organisation if needed within its possibilities. However, Koda Sail does not include organised transfer from your arrival points to your departure points and back as part of the programs when the requested service is not clearly stated in the service descriptions. Please contact Koda Sail by email in case you would like to receive further offers on your pre and post tour needs. Koda Sail claim no liability on advice or information given for 3rd party programs.

  6. Making a reservation. Reserve your spot on any of our tour programs by selecting your desired tour and departure date via our Online Booking Form. Koda Sail will check availability and email through confirmation to proceed with your booking. 

  7. Proceeding with Payment (Deposit or in Full) online by credit or debit card. Payment for Croatia & Turkey tours are accepted in Euro (€) only. Payment for Maldives in USD ($) only. 100% payment for the tour fare must be made in advance by credit or debit card (Visa, MasterCard, Maestro) plus the standard processing fee (3.95% set by Payment gateway).

  8. Booking correspondence is made by email. Customer takes responsibility to set email filters to accept our email address. No extensions will be given for misplaced emails filtered into junk mail folders.

6. Paying the Balance
  1. Online Payments: Payment can be made securely via our Online Payment gateway (PinPayments). Koda Sail will not request your credit card numbers/details at time of booking, nor will we keep any of your credit card details on file. The standard processing fee (3.95% set by PinPayments) will be applied at the time of payment.

  2. The balance of the tour must be paid no later than 60 days prior to your departure date which shall be by the due date stated on the confirmation issued to you by Koda Sail. Failure to make payment by the due date may result in your place being offered to our waitlist and forfeiting your non-refundable deposit.

  3. Sale or Discounted fares: Full payment of these fares must be made by the due date issued for the Sale offer and will be outlined on the final invoice. If deposit issue date is within 60 days of your departure date, the full cost of the tour will be payable immediately. Any discount promo codes must be used during booking process. Discounts can not be applied after the booking is made, no exceptions.

  4. Payment Plans are available on all fares. Payments are split into 3 even instalments. A once-off €15 setup fee will be added onto the first instalment. Final instalment must be completed by due date stated on the final invoice. Secure payments are made via PinPayments with credit card only.

  5. Croatia Sail product: Port Taxes & Supplements of EURO €80 per person due in cash on arrival. This applies to all Croatia bookings and will be outlined on the final invoice. 

  6. If payment is not complete by the specified due date issued, Koda Sail reserves the right to assume cancellation of your booking, and apply cancellation charges in accordance with clause 7.3 below will be levied by Koda Sail.

  7. Tickets and other documents will not be forwarded on until full payment has been received by us. The final Travel Documents will be sent approximately 31 days prior to your tour departure date.

  8. In the case of Late Bookings made within 45 days of your tour departure date, the full cost of the tour will be payable immediately on booking and we reserve the right to provide all travel documents at the tour departure point.

USING YOUR TRAVEL CREDIT

9. For customers making a booking for the 2023 season, with Travel Credit & Bonus Credit from the 2020 & 2021 season:

- If your new fare is lower than original 2020 fare paid, the difference in fare paid will remain on your file as Fully Flexible Travel Credit valid for an additional 24 months.
- Bonus Travel Credit not claimed in the 2022 season is no longer valid.

7. If You Cancel
  1. Notice of cancellation must be made in writing (email) to Koda Sail.

  2. If you cancel more than 93 days before departure, you are entitled to a refund less your non-refundable deposit and bank transaction fees incurred on original payment. Your deposit payment can not be credited to any other booking.

  3. Upon cancellation you will be liable to pay a fee to cover the estimate of cost and expenses incurred by us in the terms of the schedule set out hereunder. This is expressed as a percentage of the tour price and is calculated as follows:
    More than 93 days notice: Non-refundable Deposit is forfeited.
    92-66 days: 25% of tour fare is forfeited
    65-46 days: 40% of tour fare is forfeited
    45-31 days: 60% of tour fare is forfeited
    30-16 days: 80% of tour fare is forfeited
    15 days or less: 100% of tour fare is forfeited

  4. Where the percentage cancellation fee is less than the tour deposit, the cancellation fee will equal loss of deposit. If the reason for cancellation falls within the terms of any tour insurance policy which you hold, then any such charges may, subject to the terms of your insurance policy, be refunded to you by the insurance company.

  5. Any cancellation of additional services within 14 days from date of service, such as pre and post accommodation and transfers, will incur a 100% cancellation fee. For cancellation of additional services outside of 14 days from date of service, please refer to the above cancellation policy.

  6. These cancellation fees are in addition to any cancellation fees that may be levied by your travel agent. All Cancellation policies valid as at 1st July, 2014, and are subject to change. 

  7. All refunds can only be returned by the same method of payment made to Koda Sail through our online payment system. We can not refund to another card or via bank transfer. If your bank can not accept the refund, your fare will remain as Travel Credit for future trips and made fully flexible as per our flexible terms for use (clause 2.7). Any bank transaction fees charged on the original payment are not eligible for refund. 
    Koda Sail can not be held responsible for any additional fees your bank may charge to accept this refund
    Refund amounts are dependant on the bank’s currency conversion on the day. Koda Sail can not be held responsible for any gains or losses made by you in this transaction.

8. If You Change Your Booking
  1. If after your booking has been confirmed and more than 60 days prior to tour departure, you wish to change to an alternate departure date or you wish to change to a different Koda Sail tour, you may do so subject to availability and provided the new tour date is still currently advertised.

  2. A fee of EURO €50 per person will be charged for any revision or alteration made to a reservation after the booking is confirmed unless the change increases the value of the booking, in which case the difference must be paid.
    A change of tour date or tour itinerary booking within 60 days of tour departure will be treated as a cancellation, and normal cancellation fees will apply except when the change is to a different departure date of equivalent or greater value in which case a EURO €50 per person amendment fee will be charged. 

  3. Flexible Changes policy for 2023: If your 2023 booking is effected due to COVID-19 (Coronavirus) you are entitled to transfer your trip onto another trip in the 2023 season, subject to availability with no trip transfer fee. A difference in fare payment may apply if the departure you choose to change to is a higher fare. If you choose to amend your booking, you can select any new destination or departure date in the 2023 season. Contact Koda Sail directly to make changes to your booking. 
    Alternatively, you have the right to move your booking into Travel Credit for use in the 2024 season with no fee.

9. Tour Details and Conditions
  1. Please read the tour details online for items included in the price. No allowance or refund can be made for meals, accommodation, excursions, etc. that you elect not to take, or when museums, shops, etc. are closed.

  2. Legislation in various states in Australia, USA, Canada and the UK has highlighted the issue of Age Discrimination. In terms of style and content, all of Koda Sail’s tours are specifically designed for a particular age group. This fact should be recognised when you book one of our tours.

  3. Koda Sail strives to provide a safe, enjoyable and memorable travel experience for all travellers. Koda Sail welcomes travellers with special needs or disabilities. However, please note the following:
    • Travellers are required to advise Koda Sail, in advance, of any physical, medical or other special needs that require accommodation.
    • All guests must ensure they are medically and physically fit for travel. Koda Sail may impose safety requirements necessary for the safe operation of the tour. Koda Sail may also exclude an individual from participating in a tour or an activity if that individual’s participation poses a direct threat to health or safety.
    • Koda Sail does not provide personal devices (such as wheelchairs, hearing aids or prescription eye glasses) or services of a personal nature (such as pushing a wheelchair or assistance in eating, toileting or dressing). A companion capable of providing such assistance must accompany any passenger who requires services of a personal nature.
    • Koda Sail does not employ medical personnel. Any necessary medical attention will be provided by a local facility at the passenger’s expense. Koda Sail is not responsible or liable for any losses or costs incurred as a result of medical services obtained while on tour, or for the quality of the care or services received. 

  4. Travellers should be aware some tours include rough terrain when on land, extensive walking over cobblestone streets, uneven pavement, steps and locations which may not be easily accessible or accessible by wheelchair. Access to the boats from the port require you to walk over a gangplank (gangway) and may not always be accessible by wheelchair. During the tour, Koda Sail may make arrangements with carriers and other independent suppliers to provide travel services. These parties are independent entities over which Koda Sail has no control. Koda Sail cannot guarantee disability access or accommodations for all travellers.

  5. Koda Sail may, at its sole discretion, decline the booking of any passenger or remove any passenger who cannot comply or refuses to comply with Koda Sail’s terms and conditions. Koda Sail is not responsible for any costs incurred in the event a passenger is removed from a tour. Passengers agree not to hold Koda Sail or any of its related entities liable for any actions taken under these booking conditions.

  6. Due to specific mooring conditions and requirements in some ports, Koda Sail ships are moored side by side, making it necessary for the clients to cross from one ship to another with gaps in between ships in order to get to the shore. In such cases clients need to take special care when crossing and do this at their own risk. Crew assistance will be given to those needing and requesting it.

  7. You are responsible for all travel arrangements and costs to/from the point of commencement/conclusion of the tour.

  8. There may be times when the Koda Sail Representative has to make a decision in your best interests or the best interests of their group. You agree to comply with the authority and decisions of the appointed Koda Sail Representative and the laws of the country in which you are travelling. If you do not so comply or if, in the Koda Sail Representative’s opinion, you are not compatible with the general enjoyment and well being of other members on the tour or smooth operation of the tour itself, we reserve the right to refuse to let you continue with the tour. We do not tolerate the possession or carriage of illegal or restricted substances (drugs). Furthermore, you agree that your fellow travellers and any Koda Sail Representative has the right to travel/work in a safe environment. Any threats to their safety, well being or inappropriate behaviour by you, whether verbal or physical, will be taken extremely seriously and may result in the immediate termination of your tour. In either event, you will be responsible for your own repatriation and related costs and have no claims against us.

  9. You are responsible for any costs incurred as a result of damage or excess cleaning fees related to your accommodation. You are advised to immediately report any pre-existing damage in your room to staff and/or a Koda Sail Representative as soon as it is discovered.

  10. Guests are obliged to follow ship rules (found in written form on the ship) especially with regards to bringing drinks (alcoholic and non alcoholic) on board.

  11. It is your responsibility to have a valid passport and all visas, permits and certificates required for your selected vacation as well as any necessary vaccinations and to comply with all applicable laws. Koda Sail is not responsible for any costs incurred as a result of failing to obtain necessary visas. Any costs whatsoever regarding obtaining, replacing or changing visas whilst on tour (including accommodation, meals, flights and transfers incurred due to associated delays) are at your own expense. Ensure you have at least 6 months validity remaining on your passport before you leave your home country. Many countries will not allow entry with anything less than 6 months remaining on your passport. 
    Koda Sail are under no obligation to assist with any phone calls to embassy's or extra documentation other than your final travel documents, to obtain your entry visa.  

  12. You agree that our Koda Sail Representatives may take photographs and films of you while you are on tour and that these may be used in our brochures and/or advertising or publicity material without obtaining any further consent or payment in respect of such photographs and/or films.

  13. If any provision of this contract is held invalid or unenforceable by any court of competent jurisdiction, that provision shall be deemed to be re-written to give effect to the same purpose within the permitted limits of the law. The validity and enforceability of the other provisions shall not be affected.

  14. If you are unsuccessful in any legal action instituted against us, you agree to pay all our costs, including but not limited to, attorney/client costs.

  15. Should you have a complaint in respect of the tour, you should inform the Koda Sail Representative during the course of the tour and if the matter cannot be resolved after the representative’s best endeavours to do so during the tour, your complaint should be certified by the ship, written in ships complaints book and sent to Koda Sail within 15 days from the customer’s departure. On the contrary, such complaints will not be taken in consideration. If you choose to write to Koda Sail via email, please provide your home address so that we are able to reply to you in writing.

  16. Should any dispute arise concerning this policy, the dispute will be determined in accordance with the law of Australia and the States and Territories thereof. In relation to any such dispute the parties agree to submit to the jurisdiction of any competent court in Victoria, Australia.

  17. COVID-19 (Coronavirus): In accordance with government issued warnings, anyone who has been to specific affected countries/regions in the 14 days prior to your tour start date, must self isolate. Therefore, any person who has been to a country/region listed as "high risk" in the 14 days prior to the start of their tour departure will not be permitted to join the tour. You may be asked to sign a waiver at time of check-in to confirm this.

 
10. Insurance
  1. It is compulsory that you take out comprehensive insurance cover for cancellation, personal injury, death, medical expenses, repatriation expenses force majeure and evacuation expenses before you travel on a Koda Sail tour. As a minimum, you agree to having adequate insurance that covers cancellation, personal liability and loss of personal property. Please ensure your insurance covers all of the activities that you are going to be participating in. Some policies exclude certain adventure activities.

  2. We advise your Travel Insurance is arranged at the time of payment of the deposit as it will, in certain circumstances, cover you against loss of deposit or cancellation fees from the date of confirmation of your booking, as shown in the insurance policy. Koda Sail cannot be held responsible for your failure to take out appropriate insurance. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of your participation in the tour.

  3. You will be required to provide your Travel Insurance details to us prior to receiving your final travel documents.

  4. If your Travel Insurance is provided by your bank/credit card, we require details of that policy, including an emergency hotline number. Ensure this policy covers you for any excursions you may pay in cash, as some policies only cover you for items purchased on the card only.

11. Illness or Absenteeism
  1. In the event of your withdrawal from a tour after the commencement as a result of illness, we can assist you with finding a medical practitioner to obtain a medical certificate in support of any travel insurance claim you may want to process. No refunds will be made from Koda Sail for any absence from the trip. Any additional expenses are the guest’s responsibility.

12. What’s Not Included In The Tour Price
  1. Airfares to and from your tour destination, airport taxes, passport and visa fees, insurance, laundry, phone calls, beverages, personal expense money, medical fees, sightseeing, visits and entrance fees, meals not detailed in the itinerary, tips to Trip Managers, crew, representatives and local guides, items of a personal nature, excess baggage, optional excursions and anything else not listed in the ‘What’s Included’ section of the itinerary pages on the kodasail.com website

  2. Greece tours - A trip manager is not included in the tour. These tours are hosted by the Captain and crew of the charter.

13. Weather Conditions 
  1. The Captain and the Koda Sail team reserves the right to change the route in case of unsafe weather conditions.

  2. Under no circumstances can we be held responsible for snow or weather conditions, nor can any tour be cancelled or amended by you at any time on the basis of snow or weather conditions.

14. Special Note for All Travel by Sea
  1. Guests have to follow ship rules (to be found in written form on the ship) especially with regards to not bringing drinks on board and in case of inappropriate behaviour Koda Sail/captain reserves the right in asking clients to disembark.

  2. Koda Sail will not be responsible for any accidents that may occur onboard and insist that clients are informed of this and the need for extra observation and caution whilst being onboard or walking between ship(s) and mainland.

  3. Due to specific mooring conditions and requirements in some ports, Koda Sail ships are moored side by side, making it necessary for the clients to cross from one ship to another with gaps in between ships in order to get to the shore. In such cases clients need to take special care when crossing and do this at their own risk. Crew assistance will be given to those needing and requesting it.

15. Special Note for Hotels
  1. Guests have to follow all Hotel rules and in case of inappropriate behaviour Koda Sail and/or Hotel Management reserves the right in asking clients to leave the premises.

  2. Koda Sail will not be responsible for any accidents that may occur in the Hotel and insist that clients are informed of this.

16. Ship Rules
  1. Passengers on board are obliged to abide to the ship rules, as the Captain is responsible for the safety of all passengers and the crew. The Captain has the right to change the itinerary in case of unsafe weather or similar inappropriate conditions in ports to ensure safety on board.

  2. Passports are to be handed to the Captain for registration on the first day of the cruise and may be kept in possession by the Captain for use with documentation required by port authorities until the end of the tour. 

  3. Jumping or diving from the boat during navigation is strictly forbidden. For safety reasons climbing over the railings is also forbidden and done so at your own risk. A safe entry point to the water is provided and is our only recommendation. Jumping from the boat when anchored is done so at your own risk. Koda Sail holds no responsibility for any injuries incurred due to your decision to do so. 

  4. During rough weather movement should be done with care and as little as possible. The floors can often be wet and slippery. Passengers should take extra care crossing between the boats when they are docked together in port. Do not hesitate to ask a crew member for assistance when crossing. Movement between the ships is at the individual’s responsibility.

  5. Safety jackets are placed either under the seats in the dining area or underneath the beds in each cabin. These are required to remain in their place for use in an emergency only and may not be removed for general use as a flotation device. 

  6. As the ships are explicitly acoustic all passengers are asked to behave accordingly. Special attention must be given to night peace onboard, which officially is at 11pm (2300hrs). In National Parks even earlier night peace is required and guests will be notified of this.

  7. Clients are responsible for looking after their personal belongings whilst travelling. The Operator cannot be held responsible for any personal belongings left behind or damaged on any trip irrespective of the circumstances. It is recommended you have a lock on your suitcase/baggage for you to store away any valuables.

  8. Smoking in the restaurant area and in the cabins is forbidden. When smoking on the deck, passengers must not throw cigarette butts in the sea.

  9. Bed linens must not be taken out of the cabins.

  10. Passengers are not permitted to bring drinks and food on the boat. This includes all drinks and food products purchased on shore in ports of call. The only exceptions are: personal care products, liquid medicine, food products specifically for infants and food products for special diets. Typical regional products purchased during visits to the ports will be stored on board to be returned to passengers at the end of the cruise.

  11. Please take special attention not to throw anything into toilets except of toilette paper.

  12. Guests are obliged to respect meal times on board, which are placed on the board in the salon, as well as departure times to next port.

  13. Any damage must be compensated to the captain by the passenger. Lost cabin keys will be charged €80 per lost key.

  14. It is strictly forbidden to throw rubbish into the sea.

  15. Water is a problem on every boat, therefore please be very rational with it. The same applies to the electricity which runs on the generator.

  16. Guests must close the portholes in cabins under deck during navigation, to avoid their cabins getting wet by the sea water entering cabin through the porthole.

  17. The Captain and the crew will be available for any questions or queries and will do their best to make your stay on board a most pleasurable one. GENERAL
17. COVID-19
  1. An immanent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the WHO people with underlying medical conditions are especially vulnerable. We ask that you take personal responsibility for your wellbeing by packing any personal protective equipment and sanitisers you require. Please adopt physical distancing and hygiene practices throughout your pre-trip travel arrangements and follow all health instructions whether physical signage, or requests from our staff, once you are holidaying with us. To travel with Koda Sail, you voluntarily assume all risks related to exposure to COVID- 19.

18. Contracting Parties
  1. The Booking Conditions detailed herein contain the entire contract between you and Koda Sail. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied in writing by a duly authorised officer or director of Koda Sail.

  2. Your contract is with us as the trip operating company. At any time and at our complete discretion we may nominate to you in writing any other company or person to have the benefit of some or all of those provisions of this contract, which we may then specify, as if you had agreed the provisions concerned directly with that company or person in the first place as well as agreeing them with us. We may at our complete discretion assign all or any rights and liabilities arising under or by virtue of this or any other contract with you.

  3. Transportation companies, airlines etc. are not to be held responsible for any act, omission or event during the time travellers are not on board planes, transportation or conveyances. We rely on international convention, national and international law which may apply to the services provided by us, our suppliers or agents with respect to any claim of any nature brought by you against us as a result of the provision of those services. International conventions which apply may include: Warsaw Convention 1929, (as amended by Hague Protocol and Montreal Protocol) in relation to air travel, or Montreal Convention; the Berne Convention for rail travel; Athens Convention 1974 for carriage by sea; the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels. We are to be regarded as having all benefit of these conventions on limiting our liability in relation to any claim for death, injury, loss, damage and delay to travellers and luggage. Enrolment in and payment for a tour shall constitute agreement and acceptance by the passenger of the terms and conditions set forth here which cannot be varied except in writing by an officer of the Company.

  4. Koda Sail is not a carrier or hotelier nor does it own vessels, hotels or coaches. All bookings with carriers, hoteliers and other service providers are subject to the terms and conditions and limitations of liability imposed by those carriers, hoteliers, and other service providers. Please note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Whilst we cannot accept any responsibility for any loss as a result of such actions or as a result of any act or omission of any such third-parties, we will give every reasonable assistance in helping to resolve any reasonable dispute. Please also note that Koda Sail cannot be held responsible for the failure of any of these parties to provide facilities or services for disabled clients (see also item 9.3 under Tour Details and Conditions).

  5. Please note that no carrier depicted or recommended on our website by virtue of their endorsement of our website represent themselves either as contracting with any purchaser of a tour from Koda Sail or as having any other legal relationship with any such purchaser.

  6. Every effort is made to ensure our website is accurate, however Koda Sail cannot be held responsible for typographical errors, or errors arising from unforeseen circumstances.

  1. Koda Sail’s Maldives programmes are valid from October 2024 to May 2025

21. Privacy Policy

  1. We won’t share your personal data e.g. e-mail ID or Contact Number, with any third party not related with Koda Sail.

  2. We won’t use your email ID and name other than sending information about an Koda Sail trip or to send you a newsletter.

  3. Our newsletter will always include a link for opting out anytime. As soon as you opt-out we will remove your e-mail ID from our database.

  4. We may display advertisements on the website, which may lead you to some external website. We are not responsible for the content of the external website.

  5. Google, one of our third-party advertisers, may add a cookie to determine targeted advertisements based on your preferences and your visit to our site and other sites on the internet. You can choose to opt out of Google’s use of cookies by visiting the Google ad and content network privacy policy.

  6. We have instituted safeguards to check that our internal procedures meet our privacy policy standards. We also use our commercially reasonable efforts to be sure that third parties who work with us agree to protect personal information that they must access in order to serve our site and our visitors.

  7. Koda Sail maintains the security of your credit card data by the following measures: All online payments are transmitted immediately to a payment gateway solution via an encrypted port. Koda Sail does not store your credit card number in any of our systems. All credit card payments receive an identification number that is proof of the transaction’s acceptance into the banking system. This identification number can be used to trace any transaction back to the credit card issuer (for example, the bank that issued the MasterCard, or VISA credit card).

  8. Koda Sail collects personal information only to the extent necessary to deliver the services, products, or information you, or an agent or other passenger booking on your behalf, request.

  9. Koda Sail, either directly or through our agency and booking partners collects, holds, uses and discloses, only as necessary the personal information provided from our customers and others in the course of offering services or providing services to you. The collection of your personal information is done only to allow us to provide services to you as requested

  10. We may also collect personal information, including contact information, if you elect to enter a contest or sweepstakes with us, to subscribe to our newsletter, which we will use only to provide you with the service you have requested.

  11. Koda Sail collects personal information from those individuals applying for employment or similar positions at Koda Sail to the extent necessary to (i) identify the individual and (ii) evaluate their suitability for the position applied for. This information may include name, contact information, educational and employment background, criminal record information, residency and/or citizenship information, and other information necessary for us to screen potential employees and staff.

  12. Koda Sail collects personal information from agents and agencies to the extent required to allow agents to book Koda Sails’ trips, and to be properly credited for such booking, as necessary and as dictated by the relationship between the agent and Koda Sail. Such information may include name, employment relationship or employer information, work or business address, etc. If you are an agent travelling with Koda Sail, Koda Sail may collect the personal information noted above for other travelling passengers, as well as other employment or eligibility information. This information may be collected directly from you, or from your employer (where authorized).

  13. Where the collection of certain details of your personal information is not required in order to deliver requested services or products, you may forgo providing such details.
